Terms and Conditions

Nick France Design (“NFD,” “we,” “us,” or “our”) welcomes you. We provide you with our Services (as defined below) through our website located at nickfrancedesign.com (the “Website“) and Plans (the “Plans” and together with the Website, and Services”), subject to these terms of service (the “Terms and Conditions”) which may be updated by us from time to time without notice.

By browsing the public areas of our website or by accessing and using our Services, you acknowledge that you have read, understood, and agree to be legally bound by these terms and conditions and the terms and conditions of our Privacy Policy, which is hereby incorporated by reference (collectively, the Terms and Conditions and the Privacy Policy are referred to as the “Terms”). If you do not agree to any of these Terms, then please do not access or use the Plans and/or the Services.

We reserve the right, at our sole discretion, to modify, discontinue, or terminate the Plans and/or the Services, or to modify these Terms, at any time and without prior notice. If we modify these Terms, we will post the modification on this page.

Third-party software

Our Services may require the use of various third-party software from time to time, including without limitation, themes and plugins. In such an event, you shall be responsible for maintaining such software in accordance with these Terms. Each third-party provider may have shipping policies, return policies, cancellation policies, support terms, product warranties, privacy policies, terms of service, and other policies or terms (collectively “Third Party Policies”) governing the purchase and use of software. You should review the respective Third Party Policies. NFD is not responsible for the content of, nor does it have any control over, any Third Party Policies and you hereby release NFD, its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to any Third Party Policies, disputes with providers of such software, or any use or purchase of such software. You acknowledge that any third party software, including your purchase and use thereof, are subject to the Third Party Policies relating thereto and any of the warranty, terms, and policies of any manufacturer of such third-party software, in each case, are not NFD’s responsibility, notwithstanding any purchase of such software from NFD.

Revision Policy:

We’re determined to provide the very best services to our clients and we will continue revising until we hit the mark. You are not liable to pay an additional price if the design concepts are not changed. You will have your revised design in 48 hours.

Any changes/revisions requested after the designs are finalized will be treated as a new order and charged separately. Your project will commence according to NFD’s availability and will start after initial payment and consultation.

Refund Policy:

Refund will be nullified if cancellation has been made due to reasons non-related to NFD. Reasons such as ‘change of mind’, ‘disagreement with partner’ or other reasons that do not pertain to NFD.

• Refunds will not be honored after 7 days, from the date of purchase.
• Refunds will not be honored once the client has approved the design and the website is sent for development.
• Refunds will not be honored if the business is closing or changing name or business.

Delivery Policy:

An Order Confirmation email will be sent. The turnaround time to complete your site will depend upon you delivering your content. The content that you’re responsible to provide NFD is the written copy for each page according to your plan. Your plan does not include custom copywriting, however we can provide writing services for an additional fee. You may furnish your own images or we’ll provide stock images according to your plan. Your project will commence according to NFD’s availability. We’ll begin your project in order in which it was received, usually within 2-3 days.
